By using the FunkyKatAudio website, downloading software, creating an account, starting a trial, purchasing or unlocking Pro, or otherwise using our products or services, you agree to these Terms of Service.

If you do not agree with these terms, please do not use the website, software, accounts, trials, licenses, or related services.

FunkyKatAudio provides audio software and plugins, including FKA AutoWah, for compatible systems and digital audio workstations.

Features, formats, compatibility, pricing, product names, download availability, and supported platforms may change over time as the software evolves.

You may need an account to start a trial, unlock Pro, restore purchases, access downloads, or use certain features. You agree to provide accurate information and keep your account credentials secure.

Licenses may be tied to your account, email address, purchase record, or license status. You are responsible for activity under your account and must not share, transfer, resell, or misuse accounts or licenses.

You must not abuse trials, promo codes, account creation, license restoration, or license verification systems. We may use technical checks to prevent duplicate trial abuse, license abuse, payment fraud, or unauthorized access.

Some features may be available for free, some may be available during a free trial, and some may require a paid Pro license.

FunkyKatAudio may change feature availability, pricing, trial length, trial eligibility, or Pro license terms in future versions. Changes will not give you permission to bypass licensing or access paid features without authorization.

Payments are handled through third-party payment providers such as Razorpay. A successful payment may be required before a Pro license is issued, unlocked, restored, or made available.

Prices, discounts, promo codes, currencies, payment methods, and taxes may vary by time, region, campaign, provider, or checkout flow. You are responsible for any applicable taxes or charges shown during checkout.

FunkyKatAudio does not directly collect or store full card numbers, CVV, or full payment credentials. Payment providers may process payment data according to their own terms and policies.

Promo codes and discounts may be limited by time, account, email address, usage count, geography, product version, checkout flow, or other conditions.

We may modify, reject, or disable promo codes or discounts if we believe there is abuse, misuse, fraud, technical error, pricing error, or unintended use.

Purchases are generally final once a license has been issued. However, we want the process to be fair and support-friendly.

If you experience a genuine payment issue, duplicate charge, failed unlock, missing license, or exceptional situation, contact us at hello@funkykataudio.com and we will review the case. Refunds or corrections may be handled at our discretion and may depend on payment provider rules, applicable law, and whether the license has been used or abused.

You are responsible for checking that your computer, operating system, DAW, plugin format, and workflow are compatible before relying on the software.

FKA AutoWah may be offered for platforms and formats such as macOS, Windows, VST3, or AU where applicable. We do not promise compatibility with every DAW, host, operating system version, hardware setup, or third-party plugin environment.

You may not copy, resell, redistribute, sublicense, share, rent, lease, reverse engineer, decompile, tamper with, modify, bypass licensing for, or attempt to extract source code from the software except where applicable law expressly gives you a right that cannot be limited.

You may not share accounts or licenses, interfere with license verification, use another person's purchase or license without permission, or use the software or website for unlawful, harmful, or abusive purposes.

FunkyKatAudio may release updates, bug fixes, feature changes, compatibility changes, pricing changes, licensing changes, or new versions of the website or software.

We may also discontinue, suspend, or replace parts of the website, checkout flow, account system, download system, trial system, licensing system, or product lineup.

FunkyKatAudio owns the website, software, branding, design, audio plugin code, product names, content, graphics, copy, and related materials, except for third-party libraries, services, frameworks, or materials owned by their respective owners.

These terms give you permission to use the software and services as allowed by your license. They do not transfer ownership of any FunkyKatAudio intellectual property to you.

The website, account system, checkout flow, downloads, licenses, trials, and software are provided "as is" and "as available" to the fullest extent permitted by law.

We do not guarantee that the website or software will be error-free, uninterrupted, secure, available at all times, or compatible with every system, DAW, session, project, plugin host, or workflow.

To the fullest extent permitted by law, FunkyKatAudio will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website, software, accounts, trials, licenses, checkout, downloads, or support.

This includes lost profits, lost revenue, lost projects, lost sessions, DAW or plugin host issues, data loss, business interruption, production delays, or other consequential damages, even if we have been advised that such damages are possible.

We may suspend or terminate access to accounts, downloads, trials, licenses, Pro unlocks, or other services if we believe you have violated these terms, abused licensing, abused trials or promo codes, attempted fraud, interfered with payment or license systems, or misused the software or website.

Termination does not limit any rights or remedies we may have under these terms or applicable law.
