Terms of Service

These Terms are an agreement between you and Aman Gupta, trading as FunkyKatAudio, at B-250, First Floor, G.K. 1, New Delhi – 110048, India ("FunkyKatAudio", "we", "us" or "our").

By using the FunkyKatAudio website, downloading or using FKA AutoWah, creating an account, activating a Trial, purchasing or restoring Pro, or otherwise using our related services, you accept these Terms and our Privacy Policy. If you do not accept them, do not use the relevant service.

You must be at least 18 years old to create an account, activate a Trial, purchase a licence or use the licensing services. By doing so, you confirm that you are at least 18 and legally able to enter into this agreement.

Free mode may be used without an account. An email activation link is required for Trial and Pro activation, purchase restoration and certain licence-management functions. Dashboard access is limited to eligible beta users.

You must provide accurate information, keep access to your email account secure and promptly tell us at hello@funkykataudio.com if you suspect unauthorized account or licence use. You are responsible for activity through your account unless applicable law provides otherwise. Accounts, credentials, licences and activations must not be shared.

FKA AutoWah has Free, Trial and Pro access states. Free mode remains available without account creation but may have fewer features than Trial or Pro.

The Pro Trial lasts 14 days from activation and is limited to one Trial per person/account. The Trial is activated on one device. We use account and limited technical activation records to apply that rule and prevent abuse. When the Trial expires, Trial-only Pro features stop and the software returns to the functionality available in Free mode unless you activate a valid Pro licence.

Trial access is for evaluation, is not a paid licence and may be refused or ended where the eligibility or anti-abuse checks show a previous Trial or misuse.

One purchase grants one named individual a personal, perpetual, non-exclusive, non-transferable Pro licence to use FKA AutoWah, subject to these Terms. The licence is not sold as ownership of the software.

One Pro licence may be activated on up to two devices owned or controlled by the same named user. This is one licence with a two-device allowance, not two separate licences. The same allowance applies whether the licence was purchased directly or through an authorized reseller.

A perpetual licence means that the licensed version does not expire merely because time passes. It does not guarantee that every future operating system, host, hardware platform or third-party environment will continue to run that version.

You retain ownership of your original music, recordings, sessions and other audio created using FKA AutoWah. You may use and commercially exploit that original audio, including in client work, releases, performances, games, films and other productions.

This permission applies to audio you create; it does not permit you to copy, redistribute or exploit the software, its code, presets or other FunkyKatAudio materials separately except as expressly allowed.

You must not share an account, credential, licence or activation; permit friends or other users to use your licence; exceed the device allowance; sell, resell, assign, sublicense, rent, lease or redistribute the software or licence; make unauthorized copies; bypass licensing or access controls; or use another person's entitlement.

You must not reverse engineer, decompile, disassemble, modify or attempt to extract source code except to the limited extent that applicable law expressly permits despite this restriction. You must not interfere with the website, checkout, authentication, Trial or licensing systems, or use them unlawfully, fraudulently or abusively.

You have no automatic right to transfer, resell or assign a licence. FunkyKatAudio may, in exceptional circumstances and at its discretion, approve a transfer in writing and impose reasonable verification or administration requirements.

FunkyKatAudio and its licensors retain all rights in FKA AutoWah, the licensing technology, website, branding, designs, documentation, graphics, copy and other materials, except for third-party materials owned by their respective owners. These Terms grant limited permission to use the product; they do not transfer intellectual-property ownership.

The canonical direct price for FKA AutoWah Pro is $29 USD. Customers with an Indian billing country are offered the localized price of ₹2,799 inclusive of 18% GST. Either price may be reduced by a valid promotion displayed with its own conditions at the time of purchase. The final amount, currency, discount and tax treatment are shown at checkout before payment.

Razorpay processes direct payments under its own terms and privacy policy. A payment must be successfully verified before the Pro entitlement is fulfilled. FunkyKatAudio does not directly collect or store complete card numbers, CVV, banking passwords or complete banking credentials.

You must provide accurate billing and contact information. If a pricing, discount, payment or fulfilment error occurs, contact hello@funkykataudio.com so that it can be investigated and corrected consistently with applicable law.

A direct purchase is non-refundable once the digital software, licence or entitlement has been delivered or activated, except where a refund, replacement or other remedy is required by applicable law. This policy does not remove mandatory remedies for a product that is defective, misdescribed or otherwise non-conforming under applicable law.

Please use Free mode and the 14-day Pro Trial to evaluate compatibility and suitability before purchasing. If a legally protected issue can reasonably be resolved through technical support, contact hello@funkykataudio.com first so that we can investigate and offer an appropriate fix, replacement or other remedy. Duplicate charges, failed fulfilment and similar payment errors will also be investigated and corrected.

FKA AutoWah may be sold by authorized third-party resellers. The reseller controls its checkout and payment processing, privacy practices, and the purchase and refund terms that apply to its transaction. Review those terms before purchasing and direct transaction or refund requests to the reseller where its terms require.

Where FunkyKatAudio licence services apply to an authorized-reseller purchase, the resulting Pro licence is subject to these Terms, including the personal, non-transferable licence and two-device allowance. One purchase provides one licence with a two-device allowance, not two separate licences.

FunkyKatAudio provides product and technical support for FKA AutoWah and operates the relevant licence services as applicable. We do not control the reseller's independent checkout, payment processing, privacy practices or transaction and refund decisions.

Under the current policy, a valid Pro licence includes future FKA AutoWah updates and newly introduced FKA AutoWah features without an additional upgrade fee. We may decide the timing, content and technical requirements of updates and may change or remove features where reasonably required for product development, security, compatibility or law, without converting the perpetual licence into a subscription.

FKA AutoWah is provided in VST3, AU and standalone formats depending on the operating system. You are responsible for checking the current product requirements and testing your computer, operating system, DAW, plugin format, hardware and workflow before purchase and before critical use. We do not promise compatibility with every host, operating-system version, device or third-party environment.

An internet connection is required to start a trial, activate or restore a Pro licence, and occasionally verify the licence. Once activated, the plugin can normally be used offline.

Maintain appropriate backups of recordings, sessions, projects, presets, installers and other important data. Test the plugin, system compatibility, licence state and workflow before performances, deadlines, paid sessions or other critical use. Do not make FKA AutoWah the sole means of preserving irreplaceable work.

Product, licensing and technical support is currently provided by email at hello@funkykataudio.com. We will make reasonable efforts to investigate support requests but do not promise a particular response or resolution time unless applicable law requires one.

If FunkyKatAudio permanently shuts down its licensing service, customers with a valid Pro licence will be provided with a permanent offline unlock or an equivalent way to continue using the software. This commitment applies to both direct-purchase and authorized-reseller licences.

We may suspend or terminate an account, Trial, activation or licence-service access where reasonably necessary to investigate or respond to fraud, payment reversal, security risk, licence sharing, duplicate-Trial abuse, device-limit evasion, unauthorized copying, interference with the service or another material breach of these Terms.

Where appropriate, we may request verification or give a reasonable opportunity to correct the issue before permanent action. This does not permit us to cancel a valid perpetual licence arbitrarily and does not limit rights or remedies that cannot legally be excluded.

To the fullest extent permitted by law, and subject to the mandatory consumer protections below, the website, licensing services and software are provided on an "as available" basis. We do not warrant uninterrupted or error-free operation, continuous online-service availability, or compatibility with every system, host, session, project or workflow.

Nothing in these Terms excludes an express description or commitment we make about FKA AutoWah, including the licence grant, update policy and licensing-service continuity commitment stated above, or a warranty or remedy that applicable law does not allow us to exclude.

To the fullest extent permitted by law, FunkyKatAudio is not liable for indirect, incidental, special, consequential or commercial losses arising from FKA AutoWah or the related services, including loss of profits, income, business, opportunity, goodwill, recordings, sessions, projects or data.

For remaining direct claims, FunkyKatAudio's aggregate liability is limited to the amount you paid for the product giving rise to the claim. These exclusions and cap do not apply to fraud, wilful misconduct, liabilities or remedies that cannot legally be excluded or limited, or statutory consumer rights that applicable law preserves.

These Terms are not intended to waive rights or remedies available to you under the Consumer Protection Act, 2019 or another applicable law that cannot validly be excluded. If a term conflicts with a mandatory legal protection, that protection prevails to the extent of the conflict and the remaining Terms continue to apply.

These Terms are governed by the laws of India. Subject to mandatory consumer jurisdiction and any right to approach a competent consumer commission or other statutory forum, courts in New Delhi, India have jurisdiction over disputes arising from these Terms or the services.

Nothing in this section requires mandatory arbitration or prevents a consumer from using a competent consumer forum available under applicable law.

We may update these Terms to reflect changes in the product, services, providers or law. The revised Terms will be posted here with a new last-updated date. Where required, we will provide additional notice before a material change applies.

Changes do not retrospectively remove a paid perpetual licence, the two-device allowance, included-update policy or licensing-service continuity commitment attached to a valid purchase under these Terms, unless a change is required by law or agreed with you.
