This Privacy Policy explains how Aman Gupta, trading as FunkyKatAudio ("FunkyKatAudio", "we", "us", or "our"), collects, uses, shares, retains and protects information when you use our website, FKA AutoWah, accounts, licensing, checkout, the beta-user dashboard or support.

1. Who Operates FunkyKatAudio

FunkyKatAudio is operated by Aman Gupta, trading as FunkyKatAudio, at B-250, First Floor, G.K. 1, New Delhi – 110048, India. Aman Gupta is responsible for personal data processed through the FunkyKatAudio website, accounts, beta-user dashboard, licensing system, direct checkout and support, except where an independent provider or authorized reseller processes information under its own responsibility.

General support, privacy questions, rights requests and grievances may be sent to hello@funkykataudio.com. Support is currently provided by email.

2. Scope and the Systems We Use

This Policy covers the FunkyKatAudio public website, FKA AutoWah, email activation links, accounts, the beta-user dashboard, Free, Trial and Pro licensing, direct purchases, purchase restoration and customer support.

The website handles browsing, downloads, account access and direct checkout. FKA AutoWah communicates with the licensing service when a user requests a magic link, starts a Trial, activates or restores Pro, or when the software occasionally verifies a licence. Razorpay handles payment-method collection and payment authorization for direct purchases. An authorized reseller controls its own account, checkout, payment, tax and refund processing.

Free mode and public downloads can be used without creating a FunkyKatAudio account. The plugin does not send general plugin-use analytics to GA4. GA4 is used only on the public website as described below.

3. Information We Collect

Website and download data may include technical request and security information such as IP address, browser or user-agent information, requested page or file, timestamps and server logs. With analytics consent, we also process page views, website events, browser and device characteristics, referring pages, campaign parameters, a browser identifier and approximate location derived by Google from technical information.

Account and authentication data may include your name, email address, internal user identifier, account status, email-verification status, activation-link request and verification records, activation timestamps and beta-dashboard activity where applicable. Starting a Trial or initiating a direct purchase may create an account record for the email address supplied.

Trial data may include the product, eligibility result, start and end dates, Trial state, whether the Trial has previously been used, and limited account and technical activation records used to enforce one Trial per person/account and prevent abuse.

Licence and device data may include a derived device fingerprint, device name and type, operating system and version, FKA AutoWah version, IP address, licence and device identifiers, licence status, device-limit information, and activation, verification and last-active timestamps. The licensing service receives a derived fingerprint rather than raw hardware serial numbers. Trial is limited to one device; a personal Pro licence permits up to two devices owned or controlled by the named user.

Direct checkout data may include name, email, telephone number, billing address, country, state or region, postal code, product, price, currency, tax, discount, campaign or referral attribution, Razorpay order/payment references, payment status, timestamps, invoice and fulfilment information, and the marketing-consent choice made at checkout.

Support and beta-dashboard data may include messages, attachments and the account, licence, device, transaction or diagnostic information you provide or that is reasonably needed to investigate the request. For eligible beta users, the beta dashboard displays and permits management of account, licence, download and activated-device information.

4. Why We Process Information

We process information to provide downloads, accounts, Trial access, licences, activation, offline use, device management, purchase restoration, direct checkout, receipts and invoices; authenticate users; enforce licence and Trial rules; prevent fraud, duplicate-Trial abuse and unauthorized access; provide support; maintain and secure the service; understand consented website usage; and comply with tax, accounting, consumer-protection and other legal obligations.

Depending on the information and applicable law, processing is based on your request for and use of the service, performance of our agreement with you, compliance with legal obligations, consent for optional marketing and non-essential website analytics, and permitted legitimate uses or legitimate interests in operating, securing and defending the service. Withdrawing consent does not affect processing already lawfully carried out and does not prevent processing required to provide an existing purchase or comply with law.

India's Digital Personal Data Protection Act, 2023 and Rules are being brought into force in stages. We apply the provisions that are in force and will update our processes as further operative requirements commence. Other currently applicable Indian information-technology, privacy and consumer-protection requirements continue to apply as relevant.

5. Direct Payments and Razorpay

Direct payments are processed by Razorpay. Razorpay directly collects and processes payment-method and authorization information under its own privacy terms. FunkyKatAudio does not directly collect or store your complete card number, CVV, banking password or complete banking credentials.

Razorpay provides us with the order, payment, status, amount, currency and related transaction information needed to verify payment, issue the licence, prepare a receipt or tax invoice, investigate fraud or disputes and provide support. Razorpay may also process technical, device and fraud-prevention information independently.

6. Authorized Resellers

FKA AutoWah may be sold by authorized third-party resellers. A reseller controls its independent account, checkout, payment, tax and refund processing. Review the reseller's privacy and purchase terms before buying.

Where applicable, FunkyKatAudio may process information reasonably required to provide product support and licence services for a purchase made through an authorized reseller. FunkyKatAudio does not control the reseller's independent data collection, privacy practices or checkout and does not receive complete payment credentials from the reseller.

7. Cookies, Browser Storage and Website Analytics

GA4 is active on the production public website only after you select Allow analytics. Before that affirmative choice, the GA4 script is not loaded and website analytics events are not sent. If you reject non-essential analytics, GA4 remains disabled. You can change or withdraw your choice at any time through the Cookie settings control displayed on the website.

When analytics is allowed, Google Analytics may set the _ga cookie and a property-specific _ga_... cookie and may process a browser identifier, IP address, browser/device and operating-system information, page URL and title, referring page, approximate location, and website events. Events currently include page views, calls-to-action, sign-up attempts, download clicks, Get Pro and upgrade steps, checkout start, promo application, payment outcome and licence-unlock confirmation. FunkyKatAudio configures GA4 IP anonymization, but analytics information should not be treated as anonymous merely because that setting is enabled.

Google Signals, advertising storage, advertising personalization, advertising-user-data features and remarketing are disabled in the website configuration. FunkyKatAudio does not send an account User-ID, email address or licence fingerprint to GA4.

With analytics consent, the website also stores sanitized campaign parameters, landing page and referrer information in local and session storage and may associate that attribution with a checkout. Rejecting or withdrawing analytics removes this stored attribution and accessible GA cookies. An essential local-storage record remembers your analytics choice. Authentication, beta-dashboard interface preferences and Razorpay may use separate cookies or browser storage needed for their functions or under their own policies.

8. Transactional and Marketing Email

We may send transactional email needed to provide the service, including magic-link and account-access messages, Trial and licence messages, purchase and entitlement information, receipts, security or important service notices, and customer-support correspondence. These messages are not marketing consent.

Occasional product news, offers and promotional updates are sent only when you make a separate affirmative choice, such as the optional unticked checkbox at direct checkout or an available beta-dashboard preference. Purchasing, creating an account or starting a Trial does not by itself provide marketing consent.

You can withdraw marketing consent through available beta-dashboard notification settings or by emailing hello@funkykataudio.com. Promotional sending systems use the recorded preference. Withdrawing marketing consent does not stop transactional messages necessary to operate your account, purchase or licence.

9. Service Providers, Sharing and International Processing

We do not sell or rent personal information. We share information only as reasonably necessary with providers supporting authentication, cloud hosting, database and storage services, email delivery, Razorpay payments, consented Google Analytics, authorized-reseller licence fulfilment, and professional advice or support.

Our current infrastructure includes Google/Firebase services, Razorpay, Google Analytics when consented, and a configured transactional-email provider. These providers may process information in India or other countries in which they or their subprocessors operate. Where applicable law requires it, we use appropriate contractual, organizational or other lawful safeguards for international processing.

We may disclose information where required by law or a valid legal process, or where reasonably necessary to investigate fraud, enforce our terms, protect users and systems, or establish, exercise or defend legal claims.

10. Retention and Deletion

Account and licence records are retained while reasonably needed to provide access, validate licences, prevent abuse and verify ownership. Transaction, invoice and tax records may be retained for legally required periods. Support correspondence may be retained as reasonably required to resolve issues, maintain records and handle disputes. Information may also be retained where reasonably required for security, fraud prevention, legal claims or compliance.

Personal data is deleted or anonymized when no longer reasonably required, subject to applicable legal obligations. You may request deletion at hello@funkykataudio.com. We may need to verify your identity or ownership before acting.

Some transaction, tax, fraud-prevention and licence records may need to be retained. For eligible beta users, deleting an account may affect beta-dashboard access. Account deletion may also affect licence restoration, activation management and purchase verification. Records that must legally be retained will not be deleted merely because an account is closed.

11. Security

We use reasonable technical and organizational measures intended to protect information, including access controls, server-side payment verification, hashed or single-use security tokens where appropriate, and encrypted network connections. No method of internet transmission, software operation or electronic storage is completely secure, and we cannot guarantee absolute security.

12. Your Rights and Choices

Subject to applicable law, you may request access to information about your personal data, correction or updating of inaccurate data, deletion where applicable, and withdrawal of consent for future consent-based processing. Depending on where you live, additional rights such as restriction, objection, portability or complaint to an appropriate authority may apply.

Send a request to hello@funkykataudio.com. We may verify your identity and may decline or limit a request where retention or processing is required or permitted by law, necessary to protect another person, prevent fraud, maintain a valid licence or resolve a legal claim. Overseas customers receive rights available under the law applicable to them; this Policy does not claim universal compliance with every foreign privacy regime.

13. Adults Only

The website, accounts, Trial, purchases and FKA AutoWah licensing services are intended only for persons aged 18 years or older. We do not knowingly offer accounts, Trials or licences to children. If you believe a person under 18 has provided personal data, contact hello@funkykataudio.com so that we can investigate and take appropriate action.

14. Changes to This Policy

We may update this Policy to reflect changes in the service, providers or law. The revised Policy will be posted here with a new last-updated date. Where required, we will provide additional notice or obtain a new consent before materially different processing begins.
